Text Terms and Conditions

 

PROGRAM DESCRIPTION Pearl Hawaii Federal Credit Union (PHFCU) will use short code 74328 for Text Banking services.

 

SUPPORTED CARRIERS AT&T, Sprint, Verizon, Metro PCS, and T-Mobile. T-Mobile is not liable for delayed or delivered messages.

 

COST The PHFCU Text Banking service is available to members at no cost. Purchase is not a requirement of the SMS program. Consent to receive marketing text messages is not required as a condition of purchasing any goods or services. Message and data rates may apply. We do not charge a fee for our text message programs and assume no responsibility for charges by your carrier that you may incur when you sign up to receive text messages from us. Texts may be sent using an automatic telephone dialing system.

 

MESSAGE FREQUENCY Pearl Hawaii Alerts is a recurring and ongoing text message system with varying messages per month dependent on occurrences of account notifications, security/fraud awareness alerts, appointment reminders, missed appointment notifications, and emergency alerts for things like branch closings or system upgrades. Average messages received will be approximately 4 messages per month.

 

HOW TO OPT-OUT You may opt out of a text message program at any time by texting STOP to74328. You will receive a final confirmation message to confirm that you will no longer receive text messages from the applicable text message program unless you opt back in.

PRIVACY POLICY Pearl Hawaii Federal Credit Union’s respects your privacy. We will only use information you provide to transmit your text message. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any legal, regulatory or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide an organization the information in connection with the service, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate, or incomplete, we may refuse you access to the service and pursue any appropriate legal remedies.

 

Please be advised that data obtained from you in connection with the Service, including but not limited to your mobile phone number, your carrier’s name, the date, time, and content of your messages, and other information you provide to us in connection with the Services will be treated in accordance with our Privacy Policy. By signing up for the Service, you consent to the collection, storage, and processing of such information in accordance with our Privacy Policy.

GENERAL By signing up for Pearl Hawaii’s Alerts (the “Service”), you (i) acknowledge and represent to Pearl Hawaii Federal Credit Union and its affiliates (collectively, “Company”) that you are at least 18 years old and the owner or authorized user of the mobile phone(s) that you link to the Service; (ii) agree to receive text messages from Company, which may be sent via automated means, to the mobile phone number(s) you provide; (iii) understand that you are not required to provide consent to receive text messages via the Service as a condition of purchasing any goods or services; and (iv) expressly agree to be bound by these Terms & Conditions, including without limitation, any terms incorporated herein by reference (“Agreement”). If you do not consent to the terms of this Agreement, you must immediately cease using the Service and contact us as provided below.

Company may, at any time, revise or modify this Agreement or impose new conditions for use of the Service. Such changes, revisions, or modifications shall be effective immediately upon notice to you, which may be given by any means including, without limitation, posting on our website or by email. Any use of the Service by you after such notice shall constitute your acceptance of such changes, revisions, or modifications.

 

INDEMNIFICATION You agree to indemnify, defend, and hold Pearl Hawaii Federal Credit Union and its officers, directors, employees, agents, licensors, and service providers harmless from and against any claims, liabilities, losses, damages, judgments, awards, costs, and expenses (including reasonable attorneys’ fees) arising out of or resulting from your use of the Service.

 

DISCLAIMER OF WARRANTIES The service is provided to you on an “as is” and “as available” basis, without warranties of any kind, and Pearl Hawaii Federal Credit Union hereby disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any implied warranties. PHFCU does not make any representation or warranty with respect to the completeness, security, reliability, quality, accuracy, or availability of the service. Without limiting the foregoing, company will not be liable for any delays in the receipt of any text messages, as delivery is subject to the effective transmission from your carrier and/or network operator. The above exclusions may not apply in jurisdictions that do not allow the exclusion of certain implied warranties.

 

LIMITATION OF LIABILITY In no event will PHFCU be liable to you or any third party for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages of any kind arising out of or in connection with your use, or inability to use, the service or any text message content, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable. Use of the services is at your sole risk. Because some states do not allow the exclusion or limitation of certain categories of damages, the above limitations may not apply to you. In such states, the liability of the company parties is limited to the fullest extent permitted by such state law.

 

GOVERNING LAW; JURISDICTION AND VENUE This Agreement and any dispute or claim arising out of or related to this Agreement, its subject matter, or its formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Hawaii, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to this Agreement or the Service shall be instituted exclusively in the federal or state courts located in Honolulu, Hawaii. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

 

SEVERABILITY If any provision of these Terms is determined to be invalid or unenforceable by a court or any governmental agency having competent jurisdiction, then the remainder of these Terms will not be affected.

 

ENTIRE AGREEMENT This Agreement, together with our general Terms of Use and Privacy Policy which are incorporated herein by reference, constitutes the sole and entire agreement between you and PHFCU with respect to Pearl Hawaii Alerts, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to Pearl Hawaii Alerts.  Some of our text messaging services have additional terms and conditions that will apply in addition to the description above.
